Article 1 — Purpose
These terms of use set out the terms and conditions for accessing and using the MOXIE — The Inner Ocean application (the "Application"), published by YUPGRADE. Any use of the Application implies full acceptance of these terms of use.
Article 2 — Nature of the service
MOXIE — The Inner Ocean is a numerology and astrology application that, based on the information provided by the user (name, first name, date of birth), offers a personalized reading of her energy, presented in a narrative and symbolic form.
"Understand your energy. Never predict your future."
The Application is in no way a fortune-telling, divination, or future-prediction service. It provides no medical, psychological, financial, or legal advice. The content offered belongs to the realm of personal development and reflection, and cannot substitute for the advice of a qualified professional (doctor, psychologist, therapist, financial or legal advisor) on any matter falling within those fields.
The Application is published for entertainment and personal introspection purposes. YUPGRADE does not guarantee any result, nor any improvement in the user’s personal, professional or relational situation resulting from use of the Application.
Article 3 — Access to the Application and minimum age
The Application is accessible via web browser, and, in time, via the Apple App Store and Google Play stores. Access to certain features is subject to payment, under the terms described in the Terms of Sale.
Use of the Application is restricted to persons aged 18 or over. By creating a profile, the user declares and warrants that she is at least 18 years old.
Article 4 — Account and data entered
To access her portrait, the user provides her full birth name, date of birth, and, where applicable, her usual name and the name of her spouse or former spouse. This information is used exclusively to calculate the various elements of the portrait, according to the rules described within the Application.
Once a paid module has been purchased, the associated birth data can no longer be modified, in order to preserve the consistency of the portrait already generated and paid for.
Article 5 — Compatibility feature and third-party data
The Application offers a feature allowing the user to enter the first name, date of birth and gender of a third party (a loved one, partner, friend) in order to obtain a compatibility reading. This data is limited to what is strictly necessary and never includes the third party’s family name.
YUPGRADE does not collect any direct consent from this third party. At the time of entry, the user makes the following declaration, for which she is solely responsible:
"I certify that I am solely responsible for the information entered here, and that the person concerned has given me their consent to use it within this application, for strictly personal and confidential purposes."
The user undertakes to use this feature only for people within her real circle who have given their consent, and for strictly personal purposes.
Article 6 — User obligations
The user undertakes to:
- Provide accurate information when creating her profile;
- Not impersonate a third party or enter false information about them;
- Not attempt to circumvent the Application’s payment mechanisms;
- Not reproduce, distribute or commercialize all or part of the content generated by the Application;
- Use the Application in accordance with its intended purpose, as described in Article 2.
Article 7 — Liability
YUPGRADE implements all reasonable means to ensure continuous and secure access to the Application, without guarantee of outcome. YUPGRADE cannot be held liable for service interruptions, in particular those linked to maintenance operations, force majeure events, or failures of technical service providers (hosting, payment).
YUPGRADE cannot be held liable for the use the user makes of the information and reflections offered by the Application in her personal, professional or relational decisions.
Article 8 — Amendments to these Terms
YUPGRADE reserves the right to amend these terms of use at any time. Users will be informed of any substantial change. Continued use of the Application after a change constitutes acceptance of the new terms of use.
